OP's sister asked if OP and her husband could look after their three-year-old nephew for a few hours and she accepted. That turned into days and eventually, OP's sister said she was abandoning her son and starting her life over with her boyfriend. OP and her husband can't handle the responsibility of raising their nephew but don't want to leave him in charge of CPS.
